State challenges La Mesa appeal of license decision

Albuquerque, NM - Nov. 17, 2011 - The New Mexico Racing Commission is asking a Raton judge to dismiss La Mesa Racetrack and Casino’s appeal of the commission’s decision that La Mesa’s horseracing license for the unbuilt racino expired last year.

The commission filed the dismissal motion last week, along with a memorandum in support of the motion, claiming that Colfax County is not the proper venue for the case, the appeal notice was filed two days beyond the time limit for such notice, and La Mesa has failed to follow other judicial requirements regarding the appeal process. In addition, the racing commission is asking Judge John Paternoster, if he allows the case to proceed, to reconsider the injunction he issued in September barring the commission from accepting and considering applications for the state’s final racing license to which La Mesa developer Michael Moldenhauer claims he still has the exclusive right.
